Lontaine B.V., acting under the name Lontaine, is a company that facilitates a global service network of accommodation and care services to provide senior and cognitive care, post-surgery and rehabilitation agencies (the Services).

Why this Privacy Policy?

When you use our Website and Services, we collect certain personal data from you. Personal data is understood as all the information by which you can be (directly or indirectly) identified, such as you name, financial information and IP-address.

In this Privacy Policy we explain which personal data we collect through our Website and Services. We also explain for which purposes we use personal data, how we secure them and how long we store them.

 

Privacy and relevant legislation

We highly value your privacy. We comply with the new General Data Protection Regulation (GDPR),[1] which replaced the various privacy laws in European Member States as per 25 May 2018. We also comply with other law and regulations regarding the processing of personal data. This legislation will be referred hereinafter collectively be referred to as the Privacy Legislation.

 

Which personal data do we collect and for which purposes do we use them?

Data we collect from you if you apply for and book a trip:

Contact details (i.e. name, e-mail address, phone number), desired location and period of the trip.

We use these data to:

  • Process and review your application;
  • Contact you regarding your application;
  • Inform our external Nursing Partner(s), to optimize your intake with the Nursing Partner.

We may process these personal data, because they are necessary to perform our Agreement with you, or to take steps at your request prior to entering into the Agreement.

We will only process the desired level of care if you choose to share that information with us.

Payment of your booking

Bank information (account name, number, IBAN and BIC) or credit card information (type of credit card, name card holder, credit card number, security code (cvv) and date of expiry), and invoice information.

We use these data to:

  • process your payment;
  • include in our financial records;
  • include in the records we need to provide to the national tax authorities.

We may process these personal data, because they are necessary to perform our Agreement with you i.e. to complete your booking.

We are legally obligated to provide our financial records to the national tax authorities.

Confirmation of your booking

E-mail address

We use these data to:

  • confirm your booking;
  • introduce your (private) nurse;
  • introduce selected property and destination feature and things to do during your trip.

We may process these personal data, because they are necessary to perform our Agreement with you i.e. confirm your booking and provide you with the relevant information about your trip.

Contact form on the Website

First- and last name and e-mail address.

Optional: phone number.

We use these data to:

  • contact you and assist you with the comment or question in your message
  • improve our Services based on the feedback or question you provide us with.

We may process these personal data, because we have a legitimate interest to contact you in order to assist you with your comment or question. We also have a legitimate interest to improve our Services based on your feedback or question.

Newsletters

E-mail address

We use these data to:

  • send you interesting offers and travel options and updates about our Services.

We have a legitimate interest to keep our previous customers informed about our Services and interesting offers.

If you have never booked a trip at Lontaine before, we will only send you newsletters if you have given us your consent to do so, by providing us with your e-mail address for this purpose. You can always withdraw your permission via the unsubscribe-button in the e-mail.

  • (Keep) contact with the applicant about the application.

We may process these personal data, because we have a legitimate interest to get (and keep) in touch with the applicant and to process and review the application.

Application information

Information provided by applicant, such as:

personal data included in the Curriculum Vitae and motivation letter, qualifications, photo, gender and day of birth.

We use these data to:

  • Assess whether the applicant suits the job and to determine which applicant is the most suitable candidate.

We have a legitimate interest to process and assess the application.

We only process the personal data that applicant provided us.

Information retained during application process

Notes from interviews, information received from referees and/or training institutions.

We use these data to:

  • Assess whether the applicant suits the job and to determine which Applicant is the most suitable candidate.

We have a legitimate interest to process and assess the application.

 

Information from public sources

Information in public profiles, such as LinkedIn and other social networks (where applicable).

We use these data to:

  • Assess whether the applicant suits the job and to determine which applicant is the most suitable candidate.

We have a legitimate interest to process and assess the application. We only process information that is relevant for the application and the applicant gets the opportunity to react to our findings.

 

 

How long do we keep the personal data?

We keep the personal data as long as we need them for the purposes stated above:

  • Financial information: Personal data in our accounting records for Tax Authorities we store for 7 years;
  • E-mail address: We will store your e-mail address for 2 years after your booking in order to send you newsletters, unless you unsubscribe from the newsletters sooner;
  • Job applicants: We will store your personal data regarding the job application for 4 weeks after the applications process, unless you have given us your unambiguous consent to store your personal data for 1 year (in case of a future job opening that might match your profile);
  • All other personal data collected for your application and booking will be deleted immediately after the trip you booked has ended, unless we are legally obliged to store them.

 

Do we share your personal data with others?

First of all, we will never sell your personal data to other companies that (indirectly) do not provide services to you.

However, we do need to share some of your personal data with external parties in order to provide you our Services.

Nursing Partners

Lontaine carefully selects nursing companies (i.e. clinics, hospitals, etc.) to provide you with the necessary medical care during your trip (Nursing Partners). After the intake with Lontaine, you will have a separate intake with the relevant Nursing Partner. The Nursing Partner will discuss your precise medial needs and required care with you and will create a nursing plan accordingly. The Nursing Partner will also prepare a list of recommended activities for you, in line with your physical and mental health.

The services of the Nursing Partners will be based on a secured customer agreement between you and the Nursing Partner. Lontaine only facilitates the contact between you and the Nursing Partner and is not a party in this agreement. Lontaine will never receive any personal data you provided to the Nursing Partner. In order to learn more about the way the Nursing Partners handles your personal data, we advise you to carefully read the privacy policy of the relevant Nursing Partner.

 

Processors

We use Processors to assist us in our Services. Within this context these Processors receive personal data from us which they process by our order. We use the following types of Processors: epik.com for website and email hosting and freshbooks for payment providers.

These Processors are required to follow our instructions strictly, which are laid down in a Data Processing Agreement in accordance with the Privacy Legislation. Therefore, they will not use the personal data for their own purposes. We will verify that all our Processors comply with the Privacy Legislation.

Apart from the above, we will not share your personal data with others – unless we are legally required to do so.

 

Export of personal data outside the European Union

We may transmit personal data to parties outside the EU, if one of our Processors is established outside the EU. We will always make sure the transmission of personal data outside the EU will always happen in conformity with the Privacy Legislation (chapter 5 of the GDPR), meaning the personal data will only be transferred to a company or country that provides an adequate level of protection.

 

How do we protect personal data?

We protect all personal data we process from unauthorized and unlawful access, change, disclosure, use and destruction. For instance, we take the following technical and organizational measures to protect the personal data:
